FREQUENTLY ASKED QUESTIONS

Medical Malpractice FAQs

  • How do I know if what happened was malpractice or just a bad outcome?

A bad outcome isn’t always the result of negligence. To prove malpractice, we must show that the healthcare provider failed to act as a competent professional would have in the same situation—and that this caused you harm. We can help you evaluate your case.

  • Is there a time limit to file a malpractice claim in Illinois?

Yes. The statute of limitations for medical malpractice in Illinois is generally two years from when you knew—or should have known—that malpractice occurred, but no later than four years from the date of the incident. For minors, different rules may apply.

  • What kind of compensation can I recover?

You may be entitled to compensation for:

     • Medical expenses (past and future)

     • Lost wages or loss of earning capacity

     • Pain and suffering

     • Disability or disfigurement

     • Loss of companionship (in wrongful death cases)

  • Do I need a medical expert to file a claim?

Yes. Illinois law requires a certificate of merit from a licensed physician stating that there is reason to believe malpractice occurred. We help coordinate this process from the beginning of your case.
